Winner Winner Chicken Dinner
Like Colin (blacklab99) I have been fighting for justice, for 6 months. (anymore news Colin???)
I went on workers comp. in April.
As a lot of you will know, they take an average pay over 12 months & the insurance company pays you 95%, declining to 80%.
My problem was they refused to pay my shift penalties.
I bombarded my HR dept & insurer with, copies of the worksafe act,the award & the EA.
They still wouldn't budge, so off to "conciliation" we (finally) go. (you must go to conciliation before you can go to Fairwork).
Bastards didn't even turn up--sent an e-mail--we made a blue, we'll backpay the money.
I always knew I was right. Problem--having to drawn down over $6,000 from a housing loan (to survive), how do you calculate the cost.
My HR dept. & insurer now think this is over,but like Colin, far from it.
Compensation (stress, housing loan)??? Discrimination (of 30 shift worker I'm the only one it's happened to) ???
Now for the solicitor to go to work.
And to pee them off more--- my surgeon has given me more time off--until December.
Off work, on full pay (now) & fishing at Bonnie Doon, sounds good to me.

Been on work cover back in early 2000s....pain in butt.
Not matter how much you get in pay out ,it will not replace being 100% healthy as you were pre injury...

I have no misunderstanding. I have been fighting this for 7 months, I know exactly what my entitlements are.
An employee of the ################, if injured at work & their claim is accepted, does not lose any pay (including penalties).
Gallagher Bassett pays a percentage and the #### pays the rest.
Therefore, what I was being paid prior to my injury, I should still be paid (as confirmed by A.C.C.S.).
I have attached a spreadsheet with the correct amounts inserted.

dont forget they have to pay you interest on the money that they with hold from you also
