Can't find the reference you have for the 2 metre rule. Am I missing something?
And surely it cant apply to non fixed structures - That would be mad! Just about every boater with a moored boat would be in breach of the rule at some time.

Yes just found what you are referring to. The "intertidal zone". Something I completely missed. Bangg
But the diagram and definition refers not to depth but an area beyond the 2 metre high tide depth mark as I understand/interpret it. So it would mean that taking of any mollusc outside that area is OK. This would allow removal from non fixed floating structures so long as they were beyond that mark. This is where I get my bait at times.
I think I am right because I saw an episode of Charlie Micallef's show where he collected mussel's from the mooring ropes attached to floating bouys. They were not 2 metres deep and I would think he knows the regulations.
At this point I reckon its time for you lawyers to get involved and post an opinion.

If at low tide for eg u see some mussels that are 1.8m down.
U can't legally take them.
Once the tide is high they might be now under 2m or more in depth.
U can now take them.

Like drifta said. Intertidal zone includes the low tide mark. 2m+ of depth at low tide range and you're all sweet.
Charlie knows his regs. Providing those bouys are outside of the intertidal zone it's all sweet, doesn't matter what depth the actual mussels are in, it's the actual structure and it's relation to the shoreline and depth of water from the shoreline. Atleast that's how I've always interpreted the rule
